This agreement, together with the Web Site Rules and Regulations, contains the terms of sale by which Travel Impressions Ltd., 465 Smith Street, Farmingdale, NY 11735 ("Operator"), in consideration for a your payment, agrees to provide these travel tours. Read this agreement and the Web Site Rules and Regulations carefully before sending any money.
Reservations and Payment:
Operator accepts payment by credit card: AMERICAN EXPRESS, VISA, MASTERCARD, DINER'S CLUB OR DISCOVER. If payment is made by credit card, (1) a signed, fully completed universal charge form ("UCC" without approval) for full payment must be received to secure reservations and (2) participants in the travel tour (each, a "Participant") waive any chargeback rights. Any other person or entity (including a travel agent) who receives monies from Participants does so strictly as an agent of Participants. Tender of payment to Travel Impressions constitutes acceptance of these terms of sale.
Full payment is applied to the credit card entered into the system at the time of booking.
Bookings will be accepted until 3:00 p.m., 2 business days prior to scheduled departure. All reservations made 14 days or less prior to departure will be charged a $25.00 Special Handling Fee to cover costs associated with expedited processing of the booking. After deposit, all revisions are subject to a $25.00 per booking fee.
Responsibility and Liability:
Operator, as the principal, is responsible for arranging and providing all of the services and accommodations offered in connection with these tours. The Operator does not own or operate, nor is it an agent for any of the firms which will provide goods and services for the tour or for any option which may be available in connection with the tour (including optional side trips, car rentals, etc.) and the Operator has not priced the tour or option to allow Operator to guarantee against failure of any such firms.
Accordingly, Participant(s) agree to seek remedies directly with the supplier and not to hold the Operator liable, in the absence of its negligence, for any loss, injury, delay or expense which results directly or indirectly from any action or omission, whether negligent, criminal or otherwise, of any entity providing goods or services for the tour or any available option (e.g., the quality of services, cleanliness of a hotel, hotel overbooking or any flight delay). Participant(s) also agree not to hold Operator liable for circumstances beyond its control (e.g., natural disasters or other acts of God, terrorist activities, war, disease, acts of government authority, theft or other criminal activity, or social, labor or political unrest).
Participant(s) acknowledge that the Operator is not responsible for errors or omissions in the content of this site including but not limited to hotel descriptions. Participants(s) acknowledge that neither Operator nor its agents have made any representation or promises with respect to the tour described herein except as expressly set forth in the Operator's literature, unless such agreement is in writing and signed by an officer of Operator. At any time, the Operator may decline, for any reason, any person as a Participant on a tour (or option) whereupon the Operator's only obligation shall be to refund to such person that portion of payment allocable to the unused services.
Cancellation and Refund Policy: The right to a refund if a Participant changes plans is limited. All requests must be in writing and sent (return receipt) to the Operator. Operator will remit any refund to the Participant(s) within 14 days after receipt of the cancellation request. If your notice is received, your liquidated damages (per person) will be:
Once money received - $50.00 per person plus any supplier fees
30 days or less, prior to departure - $50.00 per person plus any supplier fees
For charter and holiday programs - Higher penalties apply
During selected holiday and peak travel periods, such as Christmas/New Year's, winter school break and Easter, your penalties may be higher and still subject to the supplier fees. All requests for refunds after a tour must be made through the booking agent and submitted to the Operator within 7 days after completion of the tour. All appropriate receipts and documentation must accompany the refund request. No refund will be made for features the Participant opts not to use.
The rights and remedies made available herein are in addition to any others available under applicable law. However, Operator offers refunds under these terms of sale with the express understanding that endorsement of a refund by Participant(s) constitutes a waiver of any such additional rights and remedies.
Forum for Disputes:
Participant and Operator agree to resolve any dispute in a court of competent jurisdiction in New York State.
Documents:
Documents will be mailed to the Ship To address that you provide in the booking or reservation approximately 21 days prior to departure.
Seating on Flights:
If available, seat assignments are made automatically at the time of booking. Infant children age 1 or under are considered lap children and will not have flight tickets for a seat.
Airport Check-in Procedure:
Failure to check in at least 2 hours prior to departure may result in denied boarding and no refund will be granted.
International Flights Only:
The operation of these flights is subject to the foreign government involved granting landing rights for the flights. If the direct air carrier cannot obtain these rights, the flights will be cancelled and full refunds will be made to all Participants.
Tour Package Price:
Prices shown are in U.S. Dollars and include only items specifically stated in Operator's current literature, the contents of which are specifically made a part hereof. Certain secondary features of a package (e.g., cocktail party, free sports) are based on supplier policy and may be changed, added or deleted after printing of literature. Operator has the right to substitute services or accommodations in similar categories for items listed in the literature. PLEASE NOTE: Operator reserves the right to reinvoice Participant(s) in case of an error made in computing tour price. The Operator is not responsible for errors or omissions in the content of this site including but not limited to hotel resort charges and hotel descriptive information.
All promotions are for selected dates only, subject to availability, are limited and apply to new bookings only. The exact price depends on the time of the actual booking. Additional restrictions may apply. All prices and dates may not be available at the time of booking. For some destinations, prices do not include departure tax. Car rental taxes and surcharges are not included in the price.
Luggage:
The limit is two pieces of checked baggage and one carry-on piece. Each piece of checked baggage may not exceed a weight of 50 lbs for domestic travel and 70 lbs for international travel. Luggage travels at the risk of the participant(s) and luggage insurance is strongly recommended. The direct air carrier's limitation on its liability for damage to or loss of participant's luggage is limited to $2,500 per ticketed passenger for domestic travel, and approximately $9.07 per pound for checked baggage up to $640 and $400 per passenger for unchecked baggage for international travel. These limitations on liability are subject to change, please contact your direct air carrier.
Proof of Citizenship:
Participant(s) are responsible for determining and obtaining proper documentation. Failure to carry proper proof of citizenship may lead to denied entry to aircraft or foreign country. A valid passport is recommended. The name on your ticket must match the name on your passport or proof of name change must be shown at check-in. All Participants are required to check with the appropriate consulate or embassy for your respective destination for entry requirements. Children traveling without parent(s) must have a letter of consent from the parent(s) not traveling, or a death certificate. There are special requirements for children with different last names than one or more of their parents or accompanying adults. No refunds will be made if improper documentation results in denied boarding or entry.
Read this if you are travelling with children:
Minor children traveling from the USA to any foreign destination, when not accompanied on a trip by both parents, must have a notarized affidavit from the parent not accompanying the child for permission to take the trip. This also applies if the child is leaving the country without either parent. If you have any further questions on this, please contact our help desk.
Aircraft, Flight Changes and Delays:
Participant(s) are subject to the ticket terms and tariffs of the airlines, which, when issued, shall be the sole contract between the airline and the Participant.
Travel Insurance: Tour cancellation, health, accident and luggage insurance is available and strongly recommended.
Travel Protection Plan Insurance:
Travel Impressions wants this tour to be the best vacation of your life. To make sure that you have a relaxing, worry-free trip, we recommend our Travel Protection Plan, designed exclusively for Travel Impressions. Should you have any questions regarding the coverage, you may call the Travel Impressions Insurance Desk at BerkelyCare (800) 453-4053.
To enroll in the plan, simply select the Trip Insurance option in the booking process and pay the Plan Cost included on your travel invoice at the time you make your trip reservation, Starting at $79 per person. Price subject to change.
Clients can cancel for any reason right up to the departure time of the flight.
Insurance Protection While Traveling:
Trip Delay up to $200:
Reimburses you for meals, lodging and unused days should your flight be delayed due to equipment failure, strike, inclement weather, etc.
Medical Expense upto $5,000:
Reimburses you for doctor and hospital charges should you become ill or injured during your trip.
Baggage/Personal Effects up to $800:
Reimburses you should your bags become lost or stolen while traveling.
$100 Bag Delay:
Reimburses you for the cost of necessary items should your bags be delayed by the airline for more than 24 hours during your trip.
Worldwide Emergency Assistance:
24 Hour access to the services of American International Assistance Services, including medical and legal referrals, emergency cash transfers, lost documents.
Note: This is not a complete description of all program benefits and limitations. Naturally, some restrictions and exclusions apply to the post departure insurance plan. Please refer to the Description of Coverage which contains the complete details of the policy terms, conditions and exclusions. If you have any questions regarding the insurance, you may call the Travel Impressions Desk at BerkelyCare, Ltd. at (800) 453-4053. The plan must be purchased at the time you make your tour deposit.
The policy (#3041-9500360) is provided in addition to other applicable insurance or indemnity programs, where permitted by law and shall apply only after benefits have been paid. The policy provides limited benefits, health-insurance only. It does NOT provide basic hospital, basic medical or major medical insurances, as defined by the New York State Insurance Department. This insurance is underwritten by National Union Fire Insurance Company of Pittsburgh, PA.
Additional Provisions Applicable to Charters:
Payment:
Credit card payment will be applied to our depository, Security Pacific National Trust Company/Travel Impressions Escrow Account.
Cancellation:
Operator may cancel any tour at any time (though less than 10 days before departure only for circumstances which make performance physically or legally impossible), in which case the Operator's liability shall be limited to a full refund within 14 days. In event of cancellation by Operator 10 or more days before the scheduled departure date, Participant(s) will be notified in writing within 7 days after the cancellation, but in any event at least 10 days before the scheduled departure. If the tour is cancelled less than 10 days before departure, the Operator will notify the Participants(s) as soon as possible. Alternatively, Operator at its option may transfer passengers to scheduled service in the event operator deems the response to the charter offering insufficient to operate a charter flight.
Security Agreement:
Any monies received by Travel Impressions, Ltd. for the payment of these flights will be held in an escrow account at Security Pacific National Trust Company, 2 Rector Street, New York, New York 10006, up to the time of departure of these flights. In addition, there is a $200,000 Letter of Credit for the protection of the Participant(s) issued by Security Pacific National Trust Company. In order for Participant(s) to file a claim, notice must be given to operator or, if operator is not available to Security Pacific National Trust Company within 60 days after termination of the flight. Security Pacific National Trust shall be released from all liability to Participants after 60 days.
Major Changes:
A "Major Change" is limited to: (1) a change in the departure or return date, except that flight delay is not a major change unless the Operator knows of it more than 2 days before the scheduled flight date or if the delay lasts more than 48 hours; (2) a change in the origin or destination city, unless the change affects only the order in which cities are visited; (3) any substitution of any hotel that is not named (as an option or otherwise) in Operator's literature; (4) a price increase to the Participant(s) which is more than 10 percent of the total price the Participant(s) are paying for the trip. Should Operator learn of the major change less than 10 days before scheduled departure, it will notify Participant(s) as soon as possible. For a full refund within 14 days, a Participant may cancel in writing (return receipt) to Operator within 7 days after receiving notice of a major change, but in no event later than departure. If notice of a major change is received after trip departure, the Participant may decline to accept the change and be sent a refund of the portion of his payments allocable to the hotel accommodations or air transportation not provided within 14 days after scheduled return date.
Notice:
Travel Impressions is not a participant in the California Travel Consumer Restitution Corporation but it is a member of the USTOA. Travel Impressions, as an Active Member of the United States Tour Operator's Association ("USTOA"), is required to post $1 Million with USTOA to be used to reimburse, in accordance with the terms of sale of the USTOA Consumer Protection Plan, the advance payments of Travel Impressions customers in the unlikely event of Travel Impressions' bankruptcy or insolvency.
